Liability Waiver
Liability Waiver, Express Assumption of Risk, Release of Liability, Hold Harmless Policy
In return for being permitted to participate in Third Way Parenting’s Parent-Child Play Group session, including any associated use or of the premises/facilities and contact/access to Shannon Foster’s curriculum, site, and group participants, you agree to release, waive, discharge, and promise not to hold liable Shannon Foster or Third Way Parenting’s Parent-Child Play Group from any and all claims, resulting in personal injury (including death), accidents or illnesses, and property loss, in connection with your or your child’s participation in hird Way Parenting’s Parent-Child Play Group and any use of the premises and facilities.
Personal Responsibility
At all times during Third Way Parenting’s Parent-Child Play Group, participants are responsible for their and their child’s safety. Likewise, information shared on this website, or in Third Way Parenting’s Parent-Child Play Group (by facilitator Shannon Foster or participants) is for informational purposes only and is NOT a substitute for individualized medical or psychological advice. Participants agree to seek individualized support if they have any questions regarding the medical or psychological well-being of themselves or their child.
Assumption of Risks
Participation in Third Way Parenting’s Parent-Child Play Group carries with it certain inherent risks that cannot be eliminated regardless of the care taken to protect and promote the safety and wellbeing of group participants. The risks include, but are not limited to the following and vary from one individual to another, but participation risks range from 1) exposure to viruses and bacteria 2) physical injuries 3) misinformation or miscommunication to 4) dissatisfaction with service or experience.
You understand and acknowledge that you may have to exercise extra care for you and your child. You further understand that beyond Shannon Foster’s up-to-date Infant and Child CPR and First Aid certification, Third Way Parenting’s Parent-Child Play Group does not have rescue or medical facilities on site or the expertise necessary to deal with any injuries and damages.
Severability
Participants further agree that their Waiver of Liability, Assumption of Risk, and Indemnity Agreement is intended to be as broad and inclusive as permitted by law, and that if any portion is held invalid the remaining portions will continue to have full legal force and effect.
Further points
You are over the age of 18 years old and consent to the participation by your child in all activities conducted by Third Way Parenting’s Parent-Child Play Group. You understand you are acting on behalf of yourself and your child, and to the extent allowed by law, you hereby waive and agree to release any claims or liability which you, your child, or your child’s heirs and successors may have or believe to have against Third Way Parenting’s Parent-Child Play Group and Shannon Foster for any injuries, losses or damages to your child, your child’s personal property and your personal property.
By purchasing a Third Way Parenting’s Parent-Child Play Group session, participants agree to indemnify and hold Shannon Foster harmless from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of participants’ access and/or involvement in Third Way Parenting’s Parent-Child Play Group, and to reimburse it for any such expenses incurred. I have read the above Liability Waiver, Express Assumption of Risk, and Release of Liability in its entirety and I freely and voluntarily assume all risks of such Injuries and Damages and notwithstanding such risks, I agree to participate in Third Way Parenting’s Parent-Child Play Group.
